Service fees are billed monthly based on your selected plan and usage. All fees are non-refundable except as expressly stated in these Terms. We reserve the right to modify pricing with 30 days' notice. Continued use of the Service after a price change constitutes acceptance of the new pricing.
Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of information as described in the Privacy Policy. You retain ownership of all data you provide to the Service.
We understand that law firms handle sensitive and confidential information. We maintain strict confidentiality of all call recordings, transcripts, and client data. Our systems are designed with security as a priority, and we do not share your data with third parties except as required to provide the Service or as required by law.
We strive to maintain 99.9% uptime for our Service. However, we do not guarantee uninterrupted access. We may temporarily suspend the Service for maintenance, updates, or circumstances beyond our control. We will provide reasonable notice when possible.
The Service, including its software, design, and content, is owned by LunaPhone.AI LLC and protected by intellectual property laws. You are granted a limited, non-exclusive license to use the Service in accordance with these Terms.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE OR UNINTERRUPTED. LUNA IS AN AI SYSTEM AND MAY OCCASIONALLY MAKE MISTAKES OR MISUNDERSTAND CALLERS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LUNAPHONE.AI LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE FEES PAID BY YOU IN THE TWELVE MONTHS PRECEDING THE CLAIM.
You agree to indemnify and hold harmless LunaPhone.AI LLC and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.
Either party may terminate this agreement at any time with 30 days' written notice. We may suspend or terminate your access immediately if you violate these Terms. Upon termination, your right to use the Service ceases, and we may delete your account data after a reasonable retention period.
We may update these Terms from time to time. We will notify you of material changes by email or through the Service. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
These Terms shall be governed by the laws of the State of Illinois, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Cook County, Illinois.
